General Terms and Conditions (GTC)
of Fechter Merch GmbH


1. Scope of Application

1.1 These General Terms and Conditions (GTC) apply in the version valid at the time of the order to all contracts concluded via the online shop of Fechter Merch GmbH (hereinafter “FM”).

1.3 Deviating, conflicting, or supplementary terms and conditions of the customer shall not become part of the contract unless FM expressly agrees to their validity in writing. This also applies if FM does not expressly object to the inclusion of such terms.


2. Contract Language

The contract is concluded exclusively in German or English.


3. Conclusion of Contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to the customer to submit an offer.

3.2 The customer submits a binding offer by completing the ordering process and finalizing the order by clicking the button “Buy now” or “Place order”.

3.3 After submitting the order, the customer receives an automatic order confirmation by e-mail. This does not constitute acceptance of the offer.

3.4 The purchase contract is only concluded upon dispatch of the goods by FM. In the case of partial deliveries, the contract is concluded only for the goods actually shipped.

3.5 FM reserves the right not to accept orders in the event of product unavailability, technical errors, or impossibility of performance. Any payments already made will be refunded immediately. Further claims are excluded.


4. Prices and Shipping Costs

4.1 All prices are final prices in euros and include the applicable statutory value-added tax (VAT).

4.2 Shipping costs are shown separately during the ordering process.

4.3 Orders with a value of EUR 150.00 or more qualify for free shipping within Austria and Germany.

4.4 No additional shipping costs will be charged in the case of partial deliveries.


5. Shipping, Customs Duties, and Import Charges

5.1 Shipping is carried out exclusively from Austria.

5.2 No customs duties or import charges apply within the European Union.

5.3 For deliveries to countries outside the EU (e.g. Switzerland), customs duties, import VAT, and handling fees charged by the shipping service provider may apply. These costs are to be borne by the customer.

5.4 For shipments to non-EU countries, delivery is carried out via UPS. UPS may charge an advance payment fee for customs clearance. FM has no influence over these costs.


6. Payment Terms

6.1 The purchase price is due immediately upon conclusion of the contract.

6.2 The following payment methods are available:

  • Credit card (Visa, Mastercard)

  • PayPal

  • Apple Pay, Google Pay

  • Instant bank transfer (Sofortüberweisung)

6.3 The account will be charged immediately upon completion of the order.


7. Delivery Times and Delays

7.1 Stated delivery times are non-binding estimates, unless expressly agreed in writing as binding.

7.2 The delivery period begins at the earliest:

  • after full receipt of payment, and

  • after all details necessary for the execution of the order have been fully clarified.

7.3 Delays due to force majeure, supply chain disruptions, delays by transport service providers, or other unforeseeable events shall extend the delivery period accordingly.

7.4 FM will inform the customer without delay of any significant delivery delays.

7.5 Withdrawal from the contract due to delivery delays is only permitted after granting a reasonable grace period, unless mandatory statutory withdrawal rights apply.


8. Retention of Title

The goods remain the property of Fechter Merch GmbH until full payment has been made.


9. Warranty and Liability

9.1 The statutory warranty provisions pursuant to Sections 922 et seq. of the Austrian Civil Code (ABGB) apply.

9.2 Obvious defects, incorrect deliveries, or transport damage must be reported immediately after receipt of the goods by e-mail, including photographic documentation, to support@sick-series.com.

9.3 FM is liable only for intent and gross negligence. Liability is limited—where legally permissible—to the typically foreseeable damage and in any case to a maximum of the net value of the goods of the affected order.

9.4 Liability under the Austrian Product Liability Act remains unaffected.


10. Force Majeure

FM shall not be liable for delays or non-performance of contractual obligations if caused by events of force majeure.

Force majeure includes, in particular:
Natural disasters, war, terrorism, pandemics, governmental measures, strikes, supply chain disruptions, transport or communication failures.

If a force majeure event persists for an extended period, FM is entitled to withdraw from the contract in whole or in part. Payments already made will be refunded; further claims are excluded.


11. Data Protection

FM processes personal data exclusively in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).

12. Right of Withdrawal (Consumers)

Consumers have the right to withdraw from the contract within 14 days without giving any reason.

(Information on the right of withdrawal and the model withdrawal form pursuant to the Austrian Distance and Off-Premises Contracts Act (FAGG) remain unchanged and are provided below.)


13. Returns

13.1 The customer bears the direct costs of returning the goods.

13.2 Cash-on-delivery or unpaid returns will not be accepted.

13.3 Returns are only accepted if the goods are unworn, undamaged, and in their original packaging.


14. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution:

FM is not obliged and not willing to participate in dispute resolution proceedings.


15. Final Provisions

15.1 Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

15.2 Place of jurisdiction is Vienna, insofar as legally permissible.

15.3 Should individual provisions be invalid, the remaining provisions of the contract shall remain unaffected.
